Terms of Service

These Terms govern your use of the MissCall service operated by IP Beauty s.r.o. (Czech Republic). MissCall is provided exclusively to users located in EU member states. Last updated: 5 May 2026.

1. Geographic Availability

1.1 EU-Only Service

MissCall is provided exclusively to users located in the European Union (EU) member states. The service is currently available in the following 27 countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.

1.2 Excluded Territories

The service is NOT available to users in:

1.3 User Representation and Warranty

By creating an account and using MissCall, you represent and warrant that:

  1. You are physically located in an EU member state at the time of registration and during use of the service;
  2. You will not use the service for sending automated SMS messages to recipients in non-EU countries (including but not limited to USA, Canada, UK, Switzerland, Australia);
  3. You will not use VPN, proxy servers, or any other means to bypass geographic restrictions implemented by MissCall;
  4. You acknowledge that the service has not been designed to comply with non-EU regulations including but not limited to:
    • Telephone Consumer Protection Act (TCPA) in the United States
    • Canadian Anti-Spam Legislation (CASL) in Canada
    • California Consumer Privacy Act (CCPA) in California
    • Spam Act 2003 in Australia
    • Federal Act on Data Protection (FADP) in Switzerland

1.4 Termination for Geographic Violation

MissCall reserves the right to:

  1. Immediately suspend or terminate any account where the user is determined to be located outside the EU;
  2. Refuse refund of any subscription fees for accounts terminated under this section, except for the unused portion of the most recent billing period;
  3. Take legal action against users who knowingly bypass geographic restrictions and cause MissCall to incur legal liability in non-EU jurisdictions.

1.5 No Liability for Use Outside EU

If a user violates this Section 1 by using MissCall outside the EU or for non-EU recipients, the user agrees to:

  1. Indemnify and hold harmless MissCall and IP Beauty s.r.o. from any claims, damages, fines, penalties, or legal fees arising from such violation;
  2. Be solely responsible for compliance with applicable laws in any non-EU jurisdiction where such use occurs.

1.6 Future Geographic Expansion

MissCall reserves the right to expand the service to additional countries in the future. Any expansion will be communicated through official channels (website, email to active users) and will be subject to updated Terms of Service applicable to those territories.

2. Service Description

MissCall is an Android application that automatically sends SMS replies to missed calls received on the user's device. The application requires a paid subscription after the trial period and operates as a software-as-a-service (SaaS) model.

3. Subscription and Payment

Pricing is described on misscall.io/en/pricing/. The first 60 days are free of charge with no credit card required. After the trial, the account converts to a free limited mode unless the user actively chooses a paid plan. All payments are processed in EUR or CZK.

5. Data Processing and GDPR

All personal data is processed in accordance with GDPR (Regulation EU 2016/679) and Czech Act 110/2019 Coll. Data is stored on EU servers (Czech Republic and Germany). See Privacy Policy for details.

6. Liability Limitations

MissCall is provided "as is" without warranty of fitness for any particular purpose. IP Beauty s.r.o. is not liable for indirect damages, lost profits, or third-party claims, except as required by mandatory consumer protection law in the user's EU country of residence.

7. Termination

The user may cancel the subscription at any time in account settings. Service remains active until the end of the paid period. Account data may be deleted upon request as required by GDPR Art. 17.

8. Governing Law and Dispute Resolution

These Terms are governed by Czech law. EU consumers retain rights under their national mandatory consumer protection law. Disputes may be resolved through the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr/

9. Changes to Terms

MissCall may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
